The ABA notes, however, that the draft in several places takes a more prescriptive approach than the current version of CPS 510, and that this may unnecessarily restrict entities’ flexibility in how they arrive at desired outcomes.

The ABA supports the development of a commonwealth VC Trust Framework and the proposed policy positions in Part B, subject to the recommendations below. The framework should be designed so that the productivity, competition and consumer benefits of VCs are realised across the whole economy, not only within the Commonwealth.

The ABA continues to support the intent of the CSLR as a last-resort scheme that compensates genuine victims where they have suffered actual financial loss as a result of financial misconduct that they have otherwise been unable to recover. Structural, targeted and technical reform is required to ensure the ongoing sustainability of the CSLR for genuine victims
